 The 30 Muharamat (Prohibitions) (Part 29) Theme: Men resembling women & women resembling men, in dress, speech & appearance ◉༺══• Part of the fitrah (natural inclinations of mankind) is that men should preserve the masculinity which Allaah has created in them, and women should preserve the femininity which Allaah has created in them. Without this, decent human life becomes impossible. Men resembling women and vice versa is something which goes against man's innate nature (fitrah) and opens the door to corruption and widespread promiscuity. The ruling in sharee'ah is that when it is stated that the person who does a thing is cursed, that thing is haraam.  Ibn 'Abbaas (may Allaah be pleased with him and his father) reported that the Messenger of Allaah (peace and blessings of Allaah be upon him) said: "Allaah has cursed the men who make themselves look like women and the women who make themselves look like men." Is it permissible for me to give zakat al-fitr to my ex-wife, as she is poor, and my son is living with her, and their situation is not good, as they do not have enough to spend on themselves?

It is not permissible for you to give your zakaah to your son, because in that way you are saving your own wealth that you should be paying on his maintenance. Did ‘Uthmaan (may Allaah be pleased with him) left the payment of zakaah to the people?

What is zakat al-fitr?

 *السَّـــــــلاَمُ عَلَيــْــكُم وَرَحْمَةُ اللهِ وَبَرَكـَـاتُه* *بِسْــــــــــــــــــــــمِ اللّهِ الرَّحْمَنِ الرَّحِيْم*             *ZAKAAT-AL-FITR* *All About Zakat al-Fitr* *What is zakat al-fitr?* Zakat al-Fitr is a kind of charity (sadaqah) that is obligatory at the time of breaking the fast of Ramadan. The word zakah is connected by idaafah (genitive structure in Arabic grammar) to fitr because the occasion of breaking the fast is the reason why this zakah becomes obligatory. Wisdom of Zakat al-Fitr Ibn ‘Abbaas said: “The Messenger of Allaah (peace and blessings of Allaah be upon him) made Zakat al-Fitr obligatory as a means of purifying the fasting person from idle talk and foul language, and to feed the poor. Whoever pays it before the prayer, it is an accepted zakah, and whoever pays it after the prayer, it is just a kind of charity (sadaqah).” (Reported by Abu Dawood, 1371. Is it permissible to give zakat al-fitr in the form of sugar, tea and canned goods?

 *السَّـــــــلاَمُ عَلَيــْــكُم وَرَحْمَةُ اللهِ وَبَرَكـَـاتُه* *بِسْــــــــــــــــــــــمِ اللّهِ الرَّحْمَنِ الرَّحِيْم*             *ZAKAAT-AL-FITR* *Question* *Is it permissible to give zakat al-fitr in the form of sugar, tea and canned goods?* *Answer* *Praise be to Allah.* *Firstly:*  It is not permissible to give zakat al-fitr except in the form of what people regard as staple foods.  This is indicated by the report narrated by al-Bukhaari (1510) from Abu Sa‘eed al-Khudri (may Allah be pleased with him) who said: At the time of the Messenger of Allah (blessings and peace of Allah be upon him) on the day of (Eid) al-Fitr, we used to give (as zakat al-fitr) a saa‘ of foodstuff, and our food at that time was barley, raisins, dried yoghurt, and dates. So they would give a saa‘ of what they ate as their staple food.  Whatever is not regarded as a staple food of the people, it is not permissible to give it as zakat al-fitr.  What is meant by “staple food” is that which people eat

Is it permissible to give zakat al-fitr in the form of dates and dried yoghurt even though these are not regarded as staple foods in many countries?

Now I have to give the accumulated zakat al-fitr on my own behalf for the past twenty-five years. Do I have to give it to 25 individuals, meaning giving it to one individual for each year? Or is it permissible to give it to a smaller number than that? How can I work out the amount of zakat al-fitr for twenty-five years?

We have a factory and a farm in which there are workers who are paid wages. Can we pay zakaat al-fitr on their behalf, or should they pay it for themselves?

 *السَّـــــــلاَمُ عَلَيــْــكُم وَرَحْمَةُ اللهِ وَبَرَكـَـاتُه* *بِسْــــــــــــــــــــــمِ اللّهِ الرَّحْمَنِ الرَّحِيْم*             *ZAKAAT-AL-FITR* *Question* *We have a factory and a farm in which there are workers who are paid wages. If a person becomes Muslim on the last day of Ramadaan, does he have to pay sadaqat al-fitr?

 *السَّـــــــلاَمُ عَلَيــْــكُم وَرَحْمَةُ اللهِ وَبَرَكـَـاتُه* *بِسْــــــــــــــــــــــمِ اللّهِ الرَّحْمَنِ الرَّحِيْم*              *ZAKAAT-AL-FITR* *Question* *If a person becomes Muslim on the last day of Ramadaan, does he have to pay sadaqat al-fitr?.* *Answer* *Praise be to Allah.* Yes, he has to pay sadaqat al-fitr, because he is now one of the Muslims, and in the hadeeth of Ibn ‘Umar (may Allaah be pleased with him) it says that the Prophet (peace and blessings of Allaah be upon him) enjoined zakaat al-fitr, a saa’ of dates, or a saa’ of barley, upon all the Muslims, slave and free, male and female, young and old. A man has done the marriage contract with a woman but he has not consummated the marriage with her. Does he have to pay zakaat al-fitr on her behalf?

 *السَّـــــــلاَمُ عَلَيــْــكُم وَرَحْمَةُ اللهِ وَبَرَكـَـاتُه* *بِسْــــــــــــــــــــــمِ اللّهِ الرَّحْمَنِ الرَّحِيْم*             *ZAKAAT-AL-FITR* *Question* *A man has done the marriage contract with a woman but he has not consummated the marriage with her. This is the Hanbali point of view.  They quoted as evidence the report narrated by al-Daaraqutni and al-Bayhaqi from Ibn ‘Umar (may Allaah be pleased with him), that the Prophet (peace and blessings of Allaah be upon him) said: “Pay sadaqat al-fitr on behalf of those whom you spend on.” But it is a da’eef (weak) hadeeth which was classed as such by al

Can a daughter pay zakat/zakat elfitr on behalf of her father?

 *السَّـــــــلاَمُ عَلَيــْــكُم وَرَحْمَةُ اللهِ وَبَرَكـَـاتُه* *بِسْــــــــــــــــــــــمِ اللّهِ الرَّحْمَنِ الرَّحِيْم*            *ZAKAAT-AL-FITR* *Question* *Can a daughter pay zakat/zakat elfitr on behalf of her father?.* *Answer* *Praise be to Allah.* Shaykh Muhammad al-‘Uthaymeen (may Allaah have mercy on him) said:  Whoever pays on behalf on one whose zakaat al-fitr he is not obliged to pay must have his permission. So if Zayd pays it on behalf of ‘Amr without his permission, that is not valid, because Zayd is not obliged to pay zakaat al-fitr on behalf of ‘Amr. It is essential that the right intention (niyyah) be formed, either on the part of the one who is obliged to pay it or on the part of the one who pays it on his behalf. This is based on a principle that is well known to the fuqaha’, which they called tasarruf al-fudooli, referring to the question of when a person acts on behalf of another without his permission, is the action completely invalid or does it depend o

Is there anything specific to be said when paying zakaat al-fitr, and what is it?

 *السَّـــــــلاَمُ عَلَيــْــكُم وَرَحْمَةُ اللهِ وَبَرَكـَـاتُه* *بِسْــــــــــــــــــــــمِ اللّهِ الرَّحْمَنِ الرَّحِيْم*             *ZAKAAT-AL-FITR* *Question* *Is there anything specific to be said when paying zakaat al-fitr, and what is it?.* *Answer* *Praise be to Allah.* We do not know of any specific du’aa’ to be said when paying it.  And Allaah is the Source of strength.

I paid zakaah al-fitr more than a week before Eid. Is that valid? If it is not valid, then what should I do?

 *السَّـــــــلاَمُ عَلَيــْــكُم وَرَحْمَةُ اللهِ وَبَرَكـَـاتُه* *بِسْــــــــــــــــــــــمِ اللّهِ الرَّحْمَنِ الرَّحِيْم*            *ZAKAAT-AL-FITR* *Question,* *I paid zakaah al-fitr more than a week before Eid. If it is not valid, then what should I do?.* *Answer* *Praise be to Allah.* *Firstly:*  The scholars differed concerning the earliest time when zakaah al-fitr may be paid, and there are several views.  1 – That it should be paid two days before Eid. This is the view of the Maalikis and Hanbalis. They quoted as evidence the hadeeth of Ibn ‘Umar (may Allaah be pleased with him) who said: They used to give (zakaat) al-fitr one or two days before (Eid). Narrated by al-Bukhaari (1511).  Some of them said it may be given three days before Eid, because of the report in al-Mudawwanah (1/385) according to which Maalik said: Naafi’ told me that Ibn ‘Umar used to send zakaat al-fitr to the one who was collecting it two or three days before (Eid) al-Fitr.  This view

Will zakaat al-fitr be accepted from a man who does not pray? And is it permissible for his wife to give it without his knowledge on behalf of herself and her children?

And is it permissible for his wife to give it without his knowledge on behalf of herself and her children?.* ,*Answer* *Praise be to Allah.* If the one who does not pray denies that prayer is obligatory, then he is a kaafir according to scholarly consensus. Does the husband have to pay zakaat al-fitr on behalf of a wife with whom he has a serious dispute, or not?

A man is obliged to pay zakaat al-fitr on behalf of himself and of everyone on whom he is obliged to spend, which includes his wife, because he is obliged to spend on her. If there is a serious dispute between them, this may be regarded as nushooz (willful defiance) which means that he is no longer obliged to spend on her. In that case he does not have to pay zakaat al-fitr on her behalf, because it is connected to the obligation to spend on her, and if he is no longer obliged to spend on her then he is no longer obliged to pay zakaat al-fitr on her behalf.  And Allaah is the Source of strength.
