*CAN YOU MARRY SOME YOU HAD SEX WITH?*
Many people among Muslims engage in the act of Zina (adultery) once or many times in their lifetime. And later, they feel the need to marry each other. So the question is can they get married?
First opinion (Shafi'i and Maliki)
Many scholars such as above, believe that people who commit Zina can marry each other but only if they REPENT. And by repentance, they need to abstain from the act. Then, the female involved needs to undergo a process called Istibra, i.e. a waiting period in which she experiences 3 menstrual cycles. This is in order to make sure that she is not pregnant and she is not carrying an unlawful child.
Second opinion. (Hanafi)
They believe even if you get married, you need to re-marry again by making a new contract. Perhaps you can do it in secret by asking an imam to renew your vows. You must not tell him what you did. Source: Al-Insaaf, 8/132; Kashshaaf al-Qinaa‘, 5/83.
Then on one side, Allah ta'alah makes a serious comment on something very disturbing :
Allah Ta'alah says in the Quran:
The adulterer — fornicator marries not but an adulteress — fornicatress or a Mushrikah; and the adulteress –fornicatress, none marries her except an adulterer — fornicater or a Mushrik [and that means that the man who agrees to marry (have a sexual relation with) a Mushrikah (female polytheist, pagan or idolatress) or a prostitute, then surely, he is either an adulterer — fornicator, or a Mushrik (polytheist, pagan or idolater). And the woman who agrees to marry (have a sexual relation with) a Mushrik (polytheist, pagan or idolater) or an adulterer — fornicator, then she is either a prostitute or a Mushrikah (female polytheist, pagan, or idolatress)]. Such a thing is forbidden to the believers (of Islâmic Monotheism) - [al-Noor 24:3].
This means that in life, anyone who engages in the act will never marry a decent person, their reward is someone like them who had committed the act. And this is why sometimes when a man marries a non-virgin, it becomes an issue. He hates her and keeps accusing her not considering the saying of Allah. So there is no way you can marry a morally sound spouse if you yourself are not morally sound. If you want a decent spouse, then be decent.
