*I am personally of the view that women should check their husband's phone and vice versa.* 


Basically I made my judgement based on the fact that situations have changed and people's lives are endangered. Women are spreading illness to their husbands via HIV and the husbands are doing the same. Just of recent, a client told me that her husband has two illegitimate children with another woman, he has been feeding them and taking care of them for years, leaving his wife and kids in poverty. Last week she checked his phone and found a conversation that gave her a stroke. 


So to keep track of your husband, I personally made the judgement that one can spy on his or her partner to ensure that they are free from any illicit activities.


but later, I dug deep into the matter, I asked questions and here is what I find out. 


The believer should think positively of his fellow Muslim and should assume the best, and interpret his affairs in a good way, and he should keep away from suspicion and negative thinking for which there is no basis, because Allah, may He be exalted, says (interpretation of the meaning): “O you who believe! Avoid much suspicions, indeed some suspicions are sins. And spy not…” [al-Hujuraat 49:12]. 


In (2/226): This verse indicates that it is emphatically prohibited to enquire into the private affairs of people and seek out their faults. The Prophet (blessings and peace of Allah be upon him) said: “Do not spy on one another, do not compete with one another, do not envy one another, do not hate one another, do not turn your backs with one another,"


So my stand now is this:


if you are suspecting your husband or a husband is suspecting his wife, confront him and ask him directly and say, "please can i check your phone because I don't trust you these days. I want to have a rest of mind. So by allowing me to check will make me have a rest of mind." 


If he honours that and give it to you fine, if he does not, then find another way to catch him red handed. 


Nevertheless, I will continue to seek fatwa on this matter until I find a tentative solution. During the time of Rasulullah men and women did not have phones. And According to Sharia, sometimes islamic ruling is discarded if the situation is strange and requires strange solutions. 


 May Almighty guide us to the right path. Amin.
