*_CAN THE WIFE SEEK OR INITIATE A DIVORCE?_*. BismilLahir Rahmanir Raheem.
Islam gives a wife the right to seek or initiate the end of a marriage when there is a VALID REASONS. This can happen through several means, the most well-known being khulʿ (where the wife requests a divorce, often by returning the mahr) or through an Islamic judge or authority who can dissolve the marriage.
ALLAH Azzawajal says:
"...If you fear that they will not be able to keep within the limits of ALLAH, then there is no blame upon either of them concerning that by which she ransoms herself..."
(Qur'an 2:229). This verse is the foundation for khulʿ, where a wife seeks release from the marriage.
The Sunnah Confirms This Right.
The wife of Thabit ibn Qays came to the Prophet ﷺ and said:
"O Messenger of ALLAH, I do not fault Thabit in his religion or character, but I dislike remaining with him (as his wife)."
The Prophet ﷺ asked if she would return the garden (her mahr) that Thabit had given her. She agreed, and the Prophet ﷺ instructed Thabit: "Accept the garden and divorce her."
This authentic narration is found in Sahih al-Bukhari. Lesson:
The wife was not accusing her husband of abuse or bad character. Even so, the Prophet ﷺ accepted her request because she sincerely believed she could no longer continue the marriage in the proper Islamic manner.
